1. Acceptance of Terms

These Terms of Service ("Terms") form a binding agreement between you and HokuQ ("HokuQ", "we", "us", or "our") and govern your access to and use of this website and any content, features, or services made available through it (collectively, the "Site"). By accessing or using the Site you agree to these Terms. If you do not agree, you may not use the Site.

2. About HokuQ

The Site is an informational resource describing HokuQ's vision and work in autonomous defense and counter-UAS technology. Nothing on the Site constitutes a product purchase, service contract, professional advice, offer, or solicitation, and no commercial relationship is formed by browsing the Site or submitting a contact form.

3. Eligibility

By using the Site you represent that you are at least 18 years of age, have the legal capacity to accept these Terms, and are not listed on any applicable sanctions, denied-parties, or embargoed-territory list, and are not otherwise prohibited by law from accessing the Site.

4. Permitted Use and Restrictions

You agree not to:

• Use the Site in violation of any law, regulation, or third-party right.
• Reverse-engineer, decompile, disassemble, or attempt to derive source code from any portion of the Site.
• Scrape, crawl, harvest, or otherwise access the Site by automated means without our prior written consent.
• Interfere with, disrupt, overload, or attempt to gain unauthorized access to the Site or related systems.
• Upload or transmit malware, exploits, or content that is unlawful, infringing, or harmful.
• Impersonate any person or misrepresent your affiliation with any person or entity.

5. Intellectual Property

The Site, including all text, graphics, logos, code, video, audio, design, and the selection and arrangement thereof, is owned by HokuQ or its licensors and is protected by copyright, trademark, and other intellectual-property laws. You are granted a limited, revocable, non-exclusive, non-transferable license to view the Site for your personal, non-commercial informational use. All other rights are reserved. The HOKUQ name and marks may not be used without our prior written permission.

6. User Submissions

If you submit information through any contact, briefing, or similar form, you represent that the information is accurate and that you have the right to submit it. Unless we agree otherwise in writing, submissions are not considered confidential. You grant us a non-exclusive, worldwide, royalty-free license to read, store, and act on your submission for the purpose of responding to you and operating the Site. We have no obligation to respond to any submission.

7. Third-Party Services

The Site may include links to or embed content from third parties. Such content is provided "as is" and we make no representations regarding it. Your interactions with third parties are solely between you and them.

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AVAILABILITY, QUIET ENJOYMENT, AND NON-INFRINGEMENT. FORWARD-LOOKING STATEMENTS ABOUT FUTURE PRODUCTS, CAPABILITIES, OR PERFORMANCE ARE NOT COMMITMENTS AND MAY CHANGE WITHOUT NOTICE.

9. Export Controls and Defense-Related Content

The Site discusses defense, counter-UAS, and dual-use technologies. You are solely responsible for complying with all applicable export-control, sanctions, and import laws, including (where applicable) the U.S. International Traffic in Arms Regulations (ITAR), Export Administration Regulations (EAR), and equivalent regimes in your jurisdiction. Nothing on the Site constitutes an offer, sale, transfer, license, or technical assistance with respect to controlled technology.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOKUQ AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD 100) OR THE MINIMUM AMOUNT PERMITTED BY APPLICABLE LAW, WHICHEVER IS GREATER.

11. Indemnification

You agree to defend, indemnify, and hold harmless HokuQ and its affiliates from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your breach of these Terms, or your violation of any law or third-party right.

12. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including suspected violation of these Terms. Sections that by their nature should survive termination will survive.

13. Governing Law and Disputes

These Terms are governed by the laws of HokuQ's principal place of business, excluding its conflict-of-laws rules. The courts located in that jurisdiction will have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Site, and you consent to personal jurisdiction there. To the extent permitted by law, you waive any right to participate in a class or representative action.

14. Miscellaneous

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver of that right. You may not assign or transfer these Terms without our prior written consent; we may assign these Terms without restriction. These Terms constitute the entire agreement between you and HokuQ regarding the Site and supersede prior agreements on the same subject.

15. Changes to These Terms

We may revise these Terms from time to time. The "Effective" date above will reflect the latest revision. Continued use of the Site after changes become effective constitutes acceptance.
